The main aim of the master's thesis – the analysis of contraband crimes investigation methodology, the identification of theoretical and practical aspects of the pre-trial investigation, trends for development and improvement. The empirical data was obtained from the Lithuanian State Border Guard Service of the Republic Ministry of the Interior Pagėgiai squad pre-trial investigations cases data analysis and an anonymous VSAT officers survey (interview). Contraband is a heavy burden for the country's economic policy planning, collection of customs duties, one of the reasons, which leads to inflation, distorts the market and creates an unbalanced relationship, fundamentally undermines the economic system. Contraband, as a criminal activity is often associated with organized crime, since, the specifics of the crime requires relevant level of expertise and organization. Contraband offenses are closely related to other crimes, such as corruption. After studies of the scientific publications on the subject, as well as criminal cases, it was found that the contraband offenses are investigated on the basis of the general types of forensic science methods, not the specific ones. Contraband offenses investigative techniques in Lithuania are still underdeveloped. According to the author, the practice is flawed because the contraband crime from other crime types is distinguished by its specificity and other crimes investigation methods are ineffective when we speak about smuggling. An empirical investigation of the criminal cases, scientific literature, author's professional work experience, was the key to distinguish the features of the contraband offenses forensic characteristic, identifying the main potential typical investigation situations, the pre-trial investigation planning and execution activities. Given the specificity of contraband offenses was investigated in separate criminal action analysis. During the analysis of the institute, the concept of the contraband offenses was formulated, also the contents of the named offenses methodology and trends for the development were revealed. In the final part of the study, based on the author's empirical research analysis, there were formulated certain propositions for law enforcement institutions, research institutions and public authorities, related to the contraband offenses investigative methodology development and smuggling prevention. |
