Abstract [eng] The subject of the master's thesis is ethical problems and their solution in social work with guardians. If a child loses parental custody for certain reasons, the guardian takes over his custody in accordance with the procedure established by law. The child's access to guardians family (caregivers) poses a number of challenges for both the child and his guardians (caregivers), so the help of a social worker as a professional is often needed to solve the problems that have arisen. The social worker assesses the readiness, motivation and strengths of the guardians to educate, raise and care for children, as well as openness to feedback and changes in order to fulfill the tasks set for the guardianship process. Providing social services to foster families often presents problematic challenges and ethical dilemmas. Therefore, in order to achieve and ensure high-quality, efficient and high ethical standards-based social services for families caring for children, it is important to know the challenges and ethical dilemmas that social workers face and how to solve them. The purpose of the research is to analyze the ethical problems that arise and the methods of solving them in social work with guardians. Research objectives: 1. To analyze the legal regulation of child custody and the aspects of social assistance in the child custody process; 2. Review the nature of ethical problems and the competence to solve them in social work with guardians; 3. To disclose the ethical problems faced by care center workers and their solution methods. In order to reveal ethical problems and ways of solving them in social work with guardians, a qualitative study was chosen, interviewing nine social workers working with families of guardians. The study revealed that social workers, working with foster families, have professional ethical problems, which are mostly related to service recipients during the assistance process: confidentiality, provision of assistance without violating the rights of the service recipient, tension due to the feelings of the service recipient, condemnation, relationship with the service recipient, mismatch of values, inflexibility of institutions, and work that does not correspond to duties. When working with child guardiands, the most effective ways to solve problems of professional ethics are finding a compromise, cooperation, relying on the code of ethics and the description of care, continuous training for caregivers, general discussion of problems in the institution, and employees' attitude to values. When solving ethical problems, it is necessary to be guided by moral, ethical, cultural and humane values, to make decisions based on competence and the uniqueness of the situation, and in order to do this as best as possible, it is necessary to constantly improve qualifications, participate in discussions, supervisions, seek new knowledge at both practical and theoretical levels, and improve their ethical knowledge and skills.
