The thesis “Unauthorized Agent in Civil Law: Comparative Analysis” tries to comparatively analyse theoretical and practical problems of civil legal relations that arise when the agent exceeds his authority or acts without it. In order to reach this goal three areas related to the actions of unauthorized agent are analyzed in this work: apparent authority, ratification of actions by unauthorized agent, and civil liability of unauthorized agent (falsus procurator). When analysing every one of them, most of the emphasis is put on the ways allowing to ensure the balance of rights and legal interests of participants in legal relations of agency (agent, principal, third persons) and other related subjects (fourth persons). |
