This master's thesis addresses the topical issues of limiting the right to freedom of expression in the Internet space. It explores the concept and essence of the right to freedom of expression, its legal regulation, and the specific aspects of its application in the digital environment. The thesis examines current international legal frameworks, the practices of the European Court of Human Rights, and the UN Human Rights Committee in protecting this right. It also analyzes the specifics of judicial practice related to the protection of the right to freedom of expression in the Internet space in Ukraine. The research highlights the challenges in ensuring the proportionality of restrictions on freedom of expression in the digital space and proposes strategies for improving legislation governing this right in Ukraine, especially considering its status as a candidate state to the European Union. This work emphasizes the importance of balancing individual freedoms with the need for responsible digital governance and provides recommendations for developing effective, proportionate, and rights-respecting legal frameworks. |
