Vilnius: Mykolas Romeris University, Institute of Criminal Law and Process, 2018. 89 p. In this Master‘s thesis assessment of children‘s testimony in the Lithuanian Criminal Code, scientific literature and Lithuanian Court practice is analyzed. In the thesis Lithuanian and foreign scientific literature regarding children‘s testimony assessment is analyzed. In the thesis Court, practice of Lithuanian Courts in analyzed that reveals what criteria courts follow when assessing children’s testimony. The first part of the thesis analyses the concept of a child in Lithuanian legal system, impact of a child‘s age, physical and mental maturity to the testimony and it‘s assessment. The second part of the thesis analyses the acquisition of children‘s testimony such as interviewing, various assessment criteria and aspects, methodologies of testimony assessment. The third part of the thesis analyses the practice of three court instances (first, appeal and cassation). |
