In this paper an analysis about the origins and evolution of the fundamental right to data protection in Europe and in Spain, a country the regulations of which in this field have always been influenced by community regulations, will be perfomed. The legal regime established by the General Data Protection Regulation for personal data breaches will be explained in greater detail, which establishes, among others, an obligation of communication on the part of the processor or controller to a data protection authority and to the data subjects affected. |
